Welcome to Pinguiino. These Terms of Service (“Terms”) govern your use of the Pinguiino website and mobile application (together, the “Service”), operated by Pinguiino (“we,” “us”). By creating an account or using the Service, you agree to these Terms.

1. What Pinguiino is

Pinguiino is a local marketplace that helps people buy, sell, trade, and give away items in their communities. We provide the platform; transactions happen directly between users. We are not a party to any sale, we do not take possession of items, and we do not guarantee any listing, buyer, or seller.

2. Eligibility and accounts

  • You must be at least 18 years old to create an account.
  • Browsing is open to everyone. Creating listings, messaging, saving items, and making offers require an account with a verified email address and a United States phone number.
  • One account per person. You are responsible for activity on your account and for keeping your credentials secure.
  • Information you provide must be accurate. Impersonating another person or business is prohibited.

3. Listings and fees

  • Standard listings are free — no listing fees, no selling fees, no commissions on sales between users.
  • Optional paid products (promoted listings, job posts, local business ads) are charged as described at the time of purchase and are non-refundable once the promotion period begins, except where required by law.
  • You may only list items you own and may lawfully sell. Prohibited: weapons, illegal goods, counterfeit items, recalled products, stolen property, live animals sold in violation of local law, adult content, and anything else we reasonably determine to be unsafe or unlawful.
  • Listings must be accurate. Misleading photos, descriptions, or pricing may result in removal and account action.

4. Transactions between users

  • Sales are agreements between the buyer and the seller. Price, payment method, meeting place, and inspection are your responsibility.
  • We strongly recommend meeting in public places, inspecting items before paying, and keeping communication on Pinguiino.
  • We do not process payments between buyers and sellers and are not responsible for payment disputes, item condition, or failure to complete a transaction.

5. Verification and trust features

We offer free identity verification that grants a verified badge, and we display trust scores and reviews based on account activity. These features are aids to your own judgment, not guarantees. A verified badge means identity documents were checked at a point in time; it does not mean we endorse a user or vouch for any transaction.

6. Content and conduct

  • You retain ownership of content you post. You grant us a worldwide, royalty-free license to host, display, and distribute it as needed to operate and promote the Service.
  • Prohibited conduct includes: harassment, hate speech, scams and fraud, spam, off-platform payment schemes designed to evade safety features, scraping, and interfering with the Service.
  • We may remove content, restrict features, suspend, or terminate accounts that violate these Terms. Enforcement actions may be appealed by contacting support.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT LISTINGS ARE ACCURATE, THAT USERS WILL PERFORM, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PINGUIINO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM TRANSACTIONS BETWEEN USERS OR IN-PERSON MEETINGS. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS OR THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.

9. Termination

You may delete your account at any time from the app (Profile → Settings → Delete account). We may suspend or terminate accounts that violate these Terms or create risk for other users.

10. Changes

We may update these Terms. Material changes will be announced in the app or by email, and continued use after the effective date constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
